Herzberg was born in 1938 in Wuppertal and received his high school diploma in 1957. He studied law at the University of Cologne. He completed the two tiers of the State Examinations in Law in 1962 and 1966 respectively. After he received his PhD in law (1966), his doctoral supervisor Dietrich Oehler also supervised his habilitation (1971).
